Bolsonaro has been arrested after authorities determined he posed a concrete flight risk while under domestic detention.

The former head of state was sentenced of orchestrating a military coup in September and sentenced more than over two decades in jail, but he continued under house arrest pending court reviews.

Brazilian Supreme Court Justice Alexandre de Moraes said the move to detain the elderly politician was a preventative measure after "new facts" were revealed.

This encompassed attempting to break his tracking device and a summons to a public vigil that could facilitate a potential flight.

Court Filing Details Escape Risks

In a filing authorising the detention, Justice Moraes said information from the unit overseeing the former president's confinement suggested the former leader's aim to disable the electronic ankle bracelet to secure accomplishment in his flight.

This, it said, would be made easier by the chaos caused by the demonstration called by his offspring.

His offspring, Flávio Bolsonaro, who holds office as a congressional representative, called for a gathering of his followers near the former president's residence to take place on Saturday night.

His son wrote on social media on the previous day: Do you plan to struggle for your homeland, or watch it all from your mobile device there on your sofa? I invite you to struggle with us."

He said the gathering would be so backers could seek divine intervention for his physical condition and for the restoration of democratic rule in our country."

Diplomatic Refuge Fears

Part of the judge's ruling was the possibility of his transfer to diplomatic missions near the residence, considering that the investigations revealed a background of arranging to seek refuge through a diplomatic representation", a declaration said.

It was only on Friday that the ex-leader's attorneys asked the Top Court to authorize him to fulfill his full incarceration period under domestic detention, with tracking devices.

They also petitioned that the former president be permitted to exit his dwelling for medical care, saying he required regular treatment for pulmonary infections and other illnesses.

Background on Conviction

Bolsonaro was convicted of orchestrating a scheme aimed at maintaining his control after he failed to win the national vote to his left-wing rival, Luiz Inácio Lula da Silva.

High Court judges said that he was aware of a plot which involved plans to assassinate the current president and his vice-presidential running mate, Geraldo Alckmin, and to arrest and execute the presiding judge - the Supreme Court justice who has been managing his judicial proceedings.

The conspiracy was prevented because it couldn't obtain the endorsement of the military leaders. The current president was inaugurated without issue on 1 January 2023.

But a following week, on 8 January, many his backers stormed and vandalised official structures in the national capital, the capital city.

The police intervened and around approximately 1,500 persons were taken into custody.

The magistrates found that the demonstrators had been provoked by Bolsonaro whose plan, they said, was for the national armed forces to take action, reestablish control and bring him back to power.

At the time, the legal team called the over 27-year sentence extremely harsh.

He was also banned from running for public office until the year 2060 - a decade minus two years after the conclusion of his imprisonment.

The former president called the court case a targeted investigation" and said it was designed to prevent him running in the 2026 national vote.
